Article 1 – Purpose

These Terms of Use (hereinafter the “Terms of Use”) set out the conditions under which any person (hereinafter the “User”) may access and use the website nakylo.com (hereinafter the “Website”).

The Website is published by Clément Touzé, sole proprietor, operating the Nakylo brand. Information about the publisher and host of the Website is provided in the Legal Notice.

Purchases made on the Website are governed by the Terms and Conditions of Sale. The processing of personal data is described in the Privacy Policy.

Article 2 – Acceptance of the Terms of Use

Accessing and using the Website implies acceptance of these Terms of Use.

Users who do not accept all or part of the Terms of Use are invited not to use the Website.

Nakylo may modify these Terms of Use at any time. The applicable version is the one published on the Website when it is consulted.

Article 3 – Access to the Website

The Website is accessible free of charge to any User with internet access. Costs related to internet access and the necessary equipment remain the User's responsibility.

The Website is in principle accessible 24 hours a day, 7 days a week. However, access may be suspended, limited or interrupted, in particular for maintenance, updates, technical problems or in the event of force majeure.

Nakylo uses the reasonable means at its disposal to provide quality access to the Website, without any obligation of result.

Article 4 – Customer account

When creating a customer account is offered, the User undertakes to provide accurate information and to keep it up to date.

The User is responsible for keeping their login details confidential and for any use of their account. In the event of unauthorized use, they are invited to notify Nakylo immediately at contact@nakylo.com.

Nakylo may suspend or delete an account if it is used in breach of these Terms of Use or of the applicable regulations.

Article 5 – User conduct

The User undertakes to use the Website fairly and in accordance with its purpose, these Terms of Use and the applicable regulations.

In particular, the User shall not:

  • interfere with the proper functioning or security of the Website;

  • attempt to access non-public parts of the Website or the systems hosting it without authorization;

  • extract the content of the Website automatically or on a large scale without authorization;

  • post unlawful, defamatory or abusive content, or content that infringes the rights of third parties;

  • use the Website for fraudulent purposes.

Article 6 – Reviews and content posted by the User

When the Website allows a review, comment or other content to be posted, the User guarantees that they are its author, that the content reflects their real experience and that it does not infringe the rights of third parties.

The User authorizes Nakylo to reproduce and distribute this content on the Website and on its communication channels for as long as it is published.

Nakylo reserves the right to moderate, refuse or remove any content that is clearly unlawful or contrary to these Terms of Use.

Article 7 – Intellectual property

Unless otherwise stated, the elements of the Website, including its structure, texts, graphics, logos, photographs, illustrations and videos, are protected by the applicable intellectual property rules.

Any reproduction, representation, modification or use of all or part of these elements without prior authorization is prohibited, except where expressly permitted by law.

Nakylo strives to provide accurate and up-to-date information, in particular about the Products. However, this information may be changed at any time.

Information about dietary supplements is provided for information purposes only. It does not replace the advice of a doctor or healthcare professional.

Article 9 – Liability

Nakylo cannot be held liable for damage resulting from an interruption of the Website, a technical malfunction, an external intrusion or use of the Website contrary to these Terms of Use.

The provisions of this article cannot have the effect of excluding or limiting the rights that Consumers are legally entitled to.

Article 10 – Hyperlinks

The Website may contain links to third-party websites or services. Nakylo does not control their content and cannot be held responsible for their practices.

Article 11 – Personal data and cookies

The User's personal data is processed in accordance with Nakylo's Privacy Policy, which describes in particular the purposes of processing, the cookies used and the rights available to the User.

Article 12 – Governing law

These Terms of Use are governed by French law, subject to any mandatory provisions that may apply to the Consumer depending on their place of residence.
